Proprietor fined over illegal in her store

KOTA KINABALU: A phone accessory store proprietor was fined RM5,000, in default two months in jail for allowing an illegal immigrant into her premises.

Nurizan Mamat, 30, admitted before Sessions Court judge Azreena Aziz to committing the offence at IZAN phone accessories store in Asia City here between 3:14pm and 3:37pm on January 14 this year.

She allowed 27-year-old Ropiya Adjalin Kunding into her premises, which is an offence under Section 55E of the Immigration Act 1959/63.

The offence provides for a maximum fine of RM60,000 or a prison term not exceeding two years, or both for each foreigner found at the premises.

In mitigation, Nurizan asked if she could pay the fine in installments, and was told by Azreena that the minimum she must pay was RM1,000.

Prosecuting officer Karmila Tabar from the Immigration Department, acted for the prosecution.

In the same court yesterday, a Filipina was charged with violating her social visit pass.

Lolita Reyes del Rosaria, 49, claimed trial to the offence she had on March 6, this year at 5pm, where she had been working as a masseus at the Shangri-La Beach Resort.

Framed under Section 39(b) of the Immigration Regulations 1959/63, the offence is punishable with a RM1,000 fine, a jail term up to six months, or both.

Inspector Jakariyah Jupakkal, who prosecuted, objected to bail, though Lolita asked that a low bail be given.

The court fixed April 20 for case management, and ordered that Lolita be furhter remanded under Section 259 of the Criminal Procedure Code, pending disposal of the case.
