KUALA LUMPUR: The High Court here yesterday rejected a preliminary objection submitted by PAS president Datuk Seri Abdul Hadi Awang and four others to strike out a suit over the tabling of the hudud laws in Parliament.
High Court judge (Appellate and Special Powers) Datuk Asmabi Mohamad made the decision in chambers in the presence of all parties representing the plaintiffs and defendants.
The presentation involved a bill to amend the Syariah Court (Criminal Jurisdiction) Act 1965.
Lawyer Farez Jinnah, representing the four plaintiffs, told reporters that the judge made the decision because she felt the materials in the application were insufficient for the preliminary objection.
Hadi filed the objection on July 2 with four other defendents, namely, Dewan Rakyat Speaker Pandikar Amin Mulia; two Deputy Speakers of the Dewan Rakyat, Datuk Ismail Mohamed Said and Datuk Seri Dr Ronald Kiandee and Secretary of the Dewan Rakyat Datuk Roosme Hamzah.
Farez said the court fixed Oct 13 to hear the application for injunction by the four to restrain Hadi and four others from tabling the bill concerned.
On June 12, four individuals, namely, Mansoor Saat, Azira Aziz, Hasbeemaputra Abu Bakar and Hazwany Jamaluddin Abu Bakar filed an originating summons by naming Abdul Hadi, Pandikar Amin Ismail, Kiandee and Roosme as first to fifth defendants.
The four individuals were also seeking a declaration that the tabling of the amendments is a breach of the terms of the Pakatan Rakyat Orange Book Pact by Abdul Hadi. — Bernama
