KUCHING (March 17): A habitual drug offender and mother of five was sentenced to five years and two months in prison by the Sessions’ Court here today for abusing methamphetamine and amphetamine.
Judge Iris Awen Jon delivered the sentence to Mariana Dan, 39, after she pleaded guilty to a charge under Section 15(1)(a) of the Dangerous Drugs Act (DDA) 1952, punishable under Section 39C(1)(b) of the same Act.
Section 39C(1)(b) of DDA 1952 provides for a prison sentence of no less than five years and not exceeding seven years, along with a maximum of three strokes of the cane upon conviction.
The court also ordered Mariana to undergo two years supervision following the completion of her sentence.
Mariana, who had two prior convictions under Section 15(1)(a) of the DDA 1952, both dated Jan 12, 2022, was charged with using amphetamine and methamphetamine.
The offence was committed at the Narcotics Criminal Investigation Department of the Kuching District Police Headquarters at 3:35pm on Nov 30, 2024,
Amphetamine and methamphetamine are classified under the First Schedule of the DDA 1952.
Deputy public prosecutor Mohamad Aiman Mutallib Mohamad Shariff prosecuted the case, while the accused was not represented by legal counsel.
