SIBU (April 8): The Sessions Court here today sentenced a 21-year-old man to a total of 20 years imprisonment and two strokes of the cane for raping his 15-year-old mistress.
Judge Musyiri Peet convicted Prem Anthony on his own guilty plea to two counts of rape under Section 376(1) of the Penal Code, which carries a maximum 20 years’ jail and caning upon conviction.
According to the first charge, he raped the victim on Feb 13 at around 12.10am at a house here, while the second charge stated he raped her again on Feb 17 at around 2.45pm at the same location.
Prem was sentenced to 10 years in jail and one stroke of the rotan for each charge.
The court also ordered for the jail sentences to run concurrently.
Based on the facts of the case, Prem’s wife informed the complainant that her husband was having an affair with the complainant’s daughter.
When the complainant confronted his daughter, she admitted to being in a relationship with Prem since February.
Suspecting his daughter had sex with Prem, the complainant lodged a police report which led to his arrest on March 31.
The police investigation revealed Prem had sexual intercourse with the victim on two occasions.
Medical examination results indicated that the victim had hymenal tears.
Deputy public prosecutor Cynthia Emmelda Jerry appeared for the prosecution while Prem did not have legal representation.
